2023 SIENNA PARKS & PATHS PHOTO CONTEST RULES
A. GENERAL REQUIREMENTS
1. All contest photographs entered in the contest (referred to herein collectively as, “Entries” or in the singular as, an “Entry”) must be
taken in a public park, path, trail, playground, or nature reserve in the Sienna project in Fort Bend County, Texas (collectively, any “Sienna Park”).
2. Only Entries that satisfy all requirements and conditions outlined in the Contest Rules will be eligible for consideration.
3. Each contestant may submit multiple Entries for consideration, but the photos must be different. The same photo cannot be submitted more than once.
4. All Entries must be in digital format and uploaded to the “Sienna Parks & Paths” contest page siennatx.com/photo-contest (the “Contest Page”) between Monday, May 1, 2023 and Friday, June 30, 2023 (11:59 PM CST) (the “Submission Deadline”). Entries will not be accepted for consideration after the Submission Deadline, provided, however, Sienna Parks & Paths Photo Contest administrators reserve the right to adjust the Submission Deadline if necessary (in their sole discretion).
5. Certain Entries will be selected by the contest judges panel for publication/reproduction in the Sienna Parks & Paths website gallery. At the time of uploading an Entry to the Contest Page, contestants must indicate how they would prefer to be credited in the event the Entry is selected for publication/reproduction in the Sienna Parks & Paths website gallery (see “Rights to Photos” for additional terms and conditions).
B. ELIGIBILITY FOR CONTEST PARTICIPANTS
1. Must be 18 years of age or older to submit photographs. Minors under the age of 18 are encouraged to participate but must have the consent of a parent or legal guardian who will either submit the photo(s) on behalf of the minor or email a signed consent form to living@siennatx.com by or before the June 30, 2023 Submission Deadline. Failure to provide the required consent prior to the expiration of the Submission Deadline will result in disqualification of the minor’s Entry or Entries. Download the consent form here.
2. With the exception of Prohibited Parties and any minors that do not comply with the requirements of the immediately preceding sentence, the Sienna Parks & Paths photo contest is open to all individuals who wish to participate, regardless of residence or citizenship, so long as the laws of their jurisdiction allow participation.
3. For purposes hereof, “Prohibited Parties” or “Prohibited Party” means any (i) employee, officer or director of The Johnson Development Corp. (“JDC”) or any affiliate or subsidiary owned or controlled by JDC and (ii) any immediate family member(s) of an employee, officer or director of JDC or any subsidiary owned or controlled by JDC. Any Entry submitted by a Prohibited Party will be disqualified from the contest and will not be eligible for a prize.
4. No purchase necessary or entry fee required to participate in the contest.
C. JUDGING CRITERIA FOR ENTRIES
1. Sienna Parks & Paths photo contest judges will choose up to Five (5) Entries that, in the judges’ sole discretion, illustrate positive experience(s) at a Sienna Park. Judges will base their selections on the composition, creativity, originality, and overall impression of an Entry.
2. Sienna Parks & Paths Photo Contest judges retain the sole discretion over the selection of, and decision not to select, any particular Entry as a winner. Judges shall determine winner eligibility in their sole and absolute discretion. All decisions are final.
3. All photos must be appropriate as determined by Sienna Parks & Paths Photo Contest administrators, who retain the sole discretion over the approval or denial of submissions.
D. PRIZES
1. After the expiration of the Submission Deadline, a panel of Sienna Parks & Paths judges will select up to Five (5) Entries as winners of the contest (see “Judging Criteria” for additional terms and conditions).
2. A contestant whose Entry is selected by the judges panel as a contest winner, will be entitled to receive a prize in the form of a $500 e-gift card to either H-E-B, Dick's Sporting Goods or Academy Sports & Outdoor (the “Prize”). If a participant submits multiple Entries and more that one (1) of the Entries is selected as a winner, then the participant will be entitled to one (1) Prize per winning Entry (for example, if a participant submits two (2) winning Entries, that participant will be entitled to Two (2) Prizes—one (1) for each winning Entry). Gift cards will be sent via email to the email address provided by the participant at the time of uploading the Entry (or Entries) to the Contest Page.
E. ANNOUNCEMENT OF WINNERS & PRIZES
1. Winning contestants (“Winners” or individually, a “Winner”) will be notified of such fact via email (a “Winner Notification”) the week of July 3rd, 2023. Winner Notices will be sent to each Winner at the email address provided by such participant at the time of uploading the Entry (or Entries) to the Contest Page.
2. Winners will be required to respond to a Winner Notification via email within seven (7) days after the date such Winner Notification is transmitted (the “Acceptance Deadline”).
3. Failure to respond to a Winner Notification by the Acceptance Deadline will result in forfeiture of the prize for such Entry (or Entries) and, in such event, an alternate winner may be selected by the judges panel (at their sole discretion).
4. Winners will be announced on the Sienna website and via Sienna’s social media channels.
F. OTHER TERMS AND CONDITIONS
1. All Entries must be the original work of the contestant that uploads such Entry (or Entries), and the contestant must own the right to distribute and reproduce the Entry.
2. Contestants must have the consent of any individuals whose faces are visible in a photo that is submitted as an Entry. Upon request, contestants may be required to provide a signed release for each individual pictured in the Entry.
3. All Entries should accurately reflect the subject matter and the scene as it appeared when the photograph was taken. All Entries that have been digitally altered beyond standard optimization for removal of dust, cropping, reasonable adjustments to exposure, color and contrast, or otherwise, will be disqualified from the contest. Multiple exposures that have been combined to produce a single High Dynamic Range (HDR) image are acceptable. Entries that do not meet these requirements may or may not be judged at the judging panel's sole discretion.
4. Sienna Parks & Paths Photo Contest administrators reserve the right to refuse photographs that contain nudity, violent or offensive material or trademarked or copyrighted images.
5. Sienna, JDC, Toll-GTIS Property Owners, LLC and any of their affiliates or subsidiaries are not responsible for lost, late, misdirected or incomplete Entries or technical errors or difficulties that may occur as a result of participating in the contest.
6. By electing to participate in the contest, participants effectively release and hold harmless Sienna, JDC, Toll-GTIS Property Owners, LLC, their employees, officers, directors and agents from any and all liability for any injuries, loss or damage of any kind arising from or in connection with the contest or any prizes awarded. Restrictions, conditions, and limitations apply.
7. By participating in this contest, each participant acknowledges, consents and agrees to the terms, conditions, limitations, requirements and other provisos set forth in these Contest Rules.
G. RIGHTS TO PHOTOS
1. Each participant will retain all rights to any photograph Entries submitted as part of the contest – including ownership, if applicable. By entering the 2023 Sienna Parks & Paths photo contest, each contestant grants Sienna, JDC and Toll-GTIS, LLC a nonexclusive right and royalty free license, in perpetuity, to:
a. Publish the images for Sienna marketing purposes in any format, including on Sienna’s website, social media accounts and in Sienna collateral, such as newsletters, brochures, magazine issues, fundraising appeals, public service announcements, displays, mailings and invitations.
b. Use, in connection with the Sienna Parks & Paths photo contest, a participant’s name, city, state and country of residence in promotions and other publications.
2. Participants are encouraged to keep the files provided and archive the images on disk or in other electronic forms, so that all Entries can be properly credited.
3. As a condition to permission to use, publish, and reproduce the Entries as contemplated by these contest rules, Sienna Parks & Paths Photo Contest administrators shall credit all Entries with the caption “©Person’s Name” when the full name is available, or by the participant’s social media handle/username when the participant’s full name is unavailable.
